Business & Expats Health insurance website privacy statement

Your privacy is important to us. We process your personal data in a lawful, fair and transparent manner and limit the processing to the data which are necessary for achieving our intended objectives. In this privacy statement, we explain to you which personal data we collect and what our processing activities are as regards your data, whether you are a customer, a potential future customer or any other person concerned (beneficiary, contact person of a company, etc.).

Data controllers and DPO (Data Protection Officer)

Helan Onafhankelijk Ziekenfonds (hereinafter referred to as "Helan"), with registered offices at Boomsesteenweg 5, 2610 Wilrijk, and company number 0411.696.011, and Partena - Mutualité Libre (hereinafter referred to as "Partenamut"), with registered offices at Boulevard Louis Mettewie 74-76, 1080 Brussels, company number 0411.815.280, act as joint data controllers (hereinafter "Business & Expats Health insurance"), as laid down in Article 26 of the European Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), for data processed in the context of the activity of Business & Expats Health insurance.
In accordance with these regulations, Helan and Partenamut have appointed a Data Protection Officer (DPO) who can be contacted by post at the following address: Partena - Mutualité Libre, Boulevard Louis Mettewie 74-76, 1080 Brussels or via the contact form available on our website.

Processing of your personal data

By completing the contact form available on our website Business & Expats Health insurance, you authorise Business & Expats Health insurance to contact you to propose Business & Expats Health insurance services, as well as Helan or Partenamut products and services - depending on where you live.
In the context of this processing, we collect and process the following personal data:

  • Surname and first name
  • Post code of your domicile
  • Email address
  • Telephone number
In the event of affiliation with Helan or Partenamut, we invite you to read our respective privacy statements to learn how we process your data and how to exercise your rights.

Who processes your data?

Your data are processed by competent staff members who are contractually bound by an obligation of confidentiality. In addition, both mutual companies have taken all necessary measures to guarantee the confidentiality, integrity and availability of your data.

Who are our subcontractors?

Business & Expats Health insurance uses the following subcontractor: MLOZ IT, Route de Lennik 788, 1070 Anderlecht as an IT service provider.

Are your data transferred to countries outside the EEA?

No

For how long are your personal data kept?

After completing our contact form, your personal data is stored in the CRM system of Helan or Partenamut for a period of 2 years. In the event of affiliation with Helan or Partenamut, the retention periods specified in our respective above-mentioned privacy statements shall apply.

What are your rights?

When your data are processed, you can assert various rights.

1. Right to consult your data

You have the right to ask Business & Expats Health insurance at any time whether or not we process your personal data and, if we do, to consult this data and to receive additional information concerning:

  • the purposes for which we process them;
  • the categories of personal data concerned;
  • the recipients or categories of recipients (including recipients in third countries);
  • if possible, the retention period or, if this is not possible, the criteria for determining this period;
  • the existence of your privacy rights;
  • the right to lodge a complaint with the supervisory authority;
  • the information we have about the source of the data if we obtain personal data through a third party; and the existence of an automatic decision-making process.
You also have the right to obtain a free copy of the processed data in an easy-to-understand form.

2. Right to rectification of your data

You have the right to have your personal data corrected if they are incomplete, incorrect, irrelevant or obsolete.
To ensure that your data is always kept up to date in your file, we ask you to inform us immediately of any changes (e.g. change of address, change of e-mail address or telephone number). 

3. Right of erasure (right to be forgotten)

If you believe that the processing of your personal data by Business & Expats Health insurance is unnecessary or unlawful, you may request that such data be deleted.
Please note that we cannot always delete the requested personal data, for example when the processing thereof is necessary to comply with one of our legal requirements, or are essential for the establishment, exercise or defence of our legal rights. We will provide you with more information in this regard in our response to your request.

4. Right to object to certain use of the data

For reasons relating to your particular situation, you have the right to object to the processing of your personal data if such processing is in the legitimate interest of Business & Expats Health insurance or in the general interest. In the event of a request on your part, Business & Expats Health insurance will no longer process your personal data, unless we can demonstrate that there are legitimate and compelling reasons for the processing which take precedence over your interests (for example, in the context of the fight against fraud) or if the processing of personal data is linked to the establishment, exercise or defence of legal rights.

5. Right to object to automatic decision-making

Certain data processing and processes may be fully automated without human intervention. If you do not agree with the consequence of such a fully automated process, you can contact Business & Expats Health insurance. You can ask for the intervention of one of our colleagues or inform us as to why you object to this decision.

6. Right to data portability

You have the right to request the transfer of personal data that you have provided to Business & Expats Health insurance yourself, to yourself or directly to a third party.
